James Moliterno is one of the US leading educators in experiential learning and legal professionalism, he created the William and Mary law school ethics, skills, and professionalism program, which won the American Bar Association Gambrell Professionalism Award, as the best law school program for the teaching of ethics and professionalism. He is the author of numerous works examining legal education and professional responsibility, including “The Law of Professional Responsibility” and “ Cases and Materials on the Law Governing Lawyers and Ethics of the Lawyers Work”.

In his seminar, Professor Moliterno outlined the differences and similarities between Medical training and legal training, and he encouraged law professors to be more experimental and create simulations of the legal practice in the class.

IE Law School Professor Gregory Marsden is currently visiting Tilburg Law School in the Netherlands, where he is teaching a series of seminars on Designing and Managing Contracts in collaboration with Professors Machteld de Hoon and Vanessa Mak. In addition, Professor Marsden presented his recent research on pre-contractual liability and its effect on negotiation practice and theory to the faculty of Tilburg\'s Private Law Department.

This visit represents the first such collaboration between IE Law School and Tilburg University, which have recently concluded an agreement for student and faculty exchange, as well as collaboration in research.

The second seminar of the Perez-Llorca / IE Chair for Commercial Law took place on September 28th with the topic of the reform of the Spanish bankruptcy regulation.  This seminar consolidates the series of research seminars that are held as part of the chair.   The PEREZ-LLORCA/IE Chair for Commercial Law is devoted to applied research and publishing in the area of commercial law with a perspective oriented to the legal practice in an international context.

 

Santiago Hurtado Iglesias (from the Spanish Ministry of Justice) was the speaker at the seminar, and exposed the most relevant aspects of the project to reform bankruptcy regulation; he was responded by Javier Yañez Evangelista (Judge in Madrid’s Commercial Court nº9) who analyzed the needs of the bankruptcy regulation; partner at Pérez-Llorca, Félix Montero, acted as moderator.  This was followed by a debate in the audience, among them there were Law Professors, partners from law firms as well as lawyers from financial institutions.

The curriculum combines law with business administration and humanities topics. A four year clinical seminar called “Law unplugged” will allow students to simulate the practice of law as they learn. Students also benefit from the exchange agreements with top law schools all over the world.

With the opening of this program, IE Law School becomes a truly full service Law School offering undergraduate, graduate and executive education programs.

The opening session of the Perez-Llorca / IE Chair for Commercial Law dedicated to applied research and publishing in the area of Commercial Law, took place on June 22nd 2010 with a seminar with the title “Los mecanismos de control reforzados de las sociedades cotizadas” (reinforced control mechanisms in listed companies) . The speaker was Francisco León, Commercial Law Professor at Universidad de Huelva and Of counsel at Pérez-Llorca, who was responded by IE Law School Professor Victor Torre de Silva.  Law Professors, partnerts from Spanish and international firms as well as notary publics atended the seminar.

 

The event started with the welcome words and introduction by IE Law School Dean, José M. de Areilza and by Pedro Pérez-Llorca, managing partner at Pérez-Llorca. Consequences of the recent legislation that forbids limits to the right to vote in the byelaws of listed companies were analyzed in the seminar.  After the presentation of the speakers, Pérez-Llorca partner Jose Ramón de Hoces moderated a very interesting debate among the participants.

Fifteen lecturers came to IE Law School and offered their analysis and engaged in discussions on topics such as the role of the USA as the only superpower, the attempt of the European Union to become a global actor, the origin and possible solutions to the global financial crisis, the political and economic situation in China and India, military and security threats, re-thinking development cooperation in Africa or understanding the recent political evolution of Latin America. Students also participated in a social event during the seminar, an evening discussion about wine and globalization and a wine tasting session, both led by Gonzalo Verdera, graduate of Harvard Business School , former McKinsey consultant and founder of the company Todovino.

This past Thursday, 7 February 2013, Stephen Denyer, Global Markets Partner for the global law firm Allen & Overy, took time from his busy schedule to speak with IE Law School’s LLM students about trends in the market for lawyers on a global scale.  The talk focused on the barriers to entry for both firms and lawyers in a variety of markets and jurisdictions and how to get around these barriers.  He also focused on ways young lawyers can position themselves to practice on an international level.

The talk forms part of a larger series of conferences called the Lawyering Seminars.  In this series IE Law School invites lawyers from a variety of professional backgrounds (from large international law firms, to in-house counsel, to lawyer entrepreneurs).  In order to give students as well rounded a view of legal practice as possible.  The next events will take place on 4, 11 and 18 April.

Vis International Commercial Arbitration Moot Court and allows participants to simulate arbitral proceedings in defense of a client.  The students start work on the problem in October and carry on until Easter.

This year’s team was composed of students Faris Shehabi (Australia), Rodrigo Tozo (Brazil), Pablo Debuchy (Paraguay) and Tan Yuan Kheng (Singapore).  These four competed against the University of Toledo (USA), University of Warsaw (Poland), University of Osnabrück (Germany) and the University of Sydney (Australia).

Professors Andrés de la Oliva, Faustino Cordón, Ignacio Díez-Picazo, Fernando Gascón, Iván Heredia, Jaime Vegas, and Julio Banacloche acted as speakers. The audience was made up by a select group of scholars, judges, attorneys, and legal advisors of the highest state institutions. 

The speakers and attendants analyzed the legislative agenda for the present term of office in civil procedure matters. They tackled, among other matters, insolvency law, voluntary jurisdiction, and international legal cooperation. Especially criticized was the strong increase in the jurisdiction tax, which could effectively hinder access to Justice. The new Judicial Office was also heavily censured, as it entrusts the handling of the procedure to court secretaries, a body dependant on the government which lacks the independence guarantees of the judiciary. Indeed, evidence was shown that, wherever the new Judicial Office has been implemented, it has resulted in chaos and inefficiency.

The moderator was Francisco Leon, Professor of Commercial Law and Of Counsel at PEREZ-LLORCA.

Alfonso Cárcamo presented the most important changes introduced by Law 25/2011, on the amendment of the Capital Companies Act, which deals with the exercise of certain rights of shareholders in public companies, aiming to facilitate the participation of shareholders in Spanish public companies. Meanwhile, Eduardo Arbizu made a critical exposition of the most contentious issues of the reform.

At the end of both presentations, an interesting debate about the implications and significance of the changes introduced by the amendment of the Capital Companies Act took place.

The Attorney General stressed that \"excellence and future elites are born of university education.\" 

The new Law Degree at IE University, is taught between the Segovia and the Madrid campus and is oriented to train lawyers for the Spanish market with an active teaching methodology. The program includes a course on lawyering that focuses on the practical elements of training. Students will learn to work and think as lawyers from the first year and will attend a number of courses in English from year one.

The conferences aimed at presenting students of the LL.M. Programs a personalized view of legal practice at both a national and international level.  It also offered different perspectives on the development of a legal career.

Attending as key speakers were, Casilda Cortés Puya, practicing lawyer and partner of Lexiusta Abogados and Solicitor in England and Wales; Ivan Mercado and Alexandra Rengel, partners of Mercado & Rengel- American Lawyers, a law firm that provides legal advice and representation to individuals and companies on an international level but principally focusing on the US and Spain; and Francisco Soler Caballero, specialist in foreign investment in China and managing partner of the Garrigues Shanghai office.

The speakers shared their particular view of the practice of law based on personal experience and discussed recent changes to the profession.  They also discussed opportunities that the internationalization and globalization of the legal market may offer lawyers today.
