Brief description

As an alternative to litigation in state courts, international arbitration is a process of resolving disputes that concludes in a binding and enforceable decision. The use of arbitration and other alternative methods of dispute resolution (ADRs) in the international commercial world has been increasing in the past years. Among the various ADR methods, international arbitration has become one of the most important mechanisms to resolve international commercial disputes.

This course seeks to explore the legal and practical aspects of international commercial arbitration in depth (investment-treaty arbitration is not specifically covered in the course).

Learning Objetives

-Understanding the aspects of international commercial arbitration that makes it attractive as a dispute resolution tool.
-Critically analyse when it is advisable to use it.
-Understanding all phases and elements of an international commercial deal including the design of an arbitration agreement and the phases leading to the enforcement of an arbitration
