OPEN TO IE STUDENTS ENROLLED IN THE FOLLOWING DEGREES (SINGLE AND DUAL): LLB, PPLE, OPEN TO ALL PROGRAMS
This course will be a preparatory course for the Helga Pedersen Moot Court Competition (https://helgapedersenmoot.elsa.org) organized by the European Law Students’ Association (ELSA). Students will be asked to solve a hypothetical, complex case on European Human Rights Law and argue it as if they were pleading before the European Court of Human Rights. Following the submission of written pleadings by December 2023, the four best students of this course will have the opportunity to represent IE University in the 2024 Helga Pedersen Moot Court Competition. Preliminary oral rounds are held at three different locations in Europe. The oral regional rounds of the competition will take place in Spring 2024. Only 18 teams are then selected to go to the final oral rounds after praticipating in the regional rounds. If the team is selected to go to the final oral round, the students will have the opportunity to represent IE University in the Helga Pedersen Moot Court Competition in Strasbourg, France.
The aim of the course is to improve the legal research and legal analysis and reasoning skills, as well as argumentation skills of all students taking this course and to prepare the students participating for the 2023-2024 Helga Pedersen Moot Court Competition. Students will also deepen their knowledge on the European Convention and develop litigation skills before the European Court on Human Rights.
The Learning objectives of this course are the following:
-To gain an overview of the legal framework and working practices of the European Court on Human Rights;
-To improve students’ skills to conduct legal research and legal analysis, and to understand and interpret statutory provisions and case law;
-To learn how to apply European Human Rights Law in practice by solving and arguing a complex case;
-To learn to explain legal rules and their effects clearly and persuasively;
-To acquire deeper knowledge of the European Convention on Human Rights;
-The competition is a unique opportunity for students to gain practical experience comparable to real pleadings in front of the European Court of Human Rights.
